"Terms of service" refers to the legal agreement between a service provider (STAT RIDE LLC) and a user (That's You!). It outlines the rules and guidelines that govern the use of the service, including the user's rights and responsibilities. It is important to carefully read and understand the terms of service before using a service. PLEASE read our terms of service carefully.

These terms and conditions (the "Terms and Conditions") govern the use of www.stat-ride.com (the "site") and STAT! Ride (the "business"). This site is owned and operated by STAT Ride LLC. This site is a Transportation Service.

By Using this site or the STAT Ride LLC services, you indicate that you have read and understand these terms and conditions and agree to abide by them at all times.

THESE TERMS AND CONDITIONS CONTAIN A DISPUTE RESOLUTION CLAUSE THAT IMPACTS YOUR RIGHTS ABOUT HOW TO RESOLVE DISPUTES. PLEASE READ IT CAREFULLY.

Intellectual Property

All content published and made available on our Site or in Print is the property of STAT Ride LLC and the Site's creators. That includes, but is not limited to images, texts, logos, videos, documents, downloadable files, and anything that contributes to the composition of our Site or Business.

Acceptable Use

As a user of our Site or Services, you agree to use our Site and Services legally, not to use our Site or Services for illegal purposes, and not to:

Harass or mistreat other users, customers, guests, employees of this Site and Business:
Violate the rights of other users, customers, guests, employees of this Site and Business:
Violate the intellectual property rights of the Site owners or any third parties to the Site;
Hack into the accounts of another user of the Site;
Act in any way that could be considered fraudulent;
Post any material that is deemed inappropriate or offensive; and
Posting any advertisements for another company or competitor.

If we believe that you are using our Site or Services illegally or in a manner that violates these Terms and Conditions, we reserve the right to limit, suspend, or terminate your access to our Site and Services. We also reserve the right to take any legal steps necessary to prevent you from accessing our Site or using our Services. We are also obligated by law to report any illegal activities we become aware of.

User Contributions

Users may post the following contributions to our Site:

Photos;
Videos;
Reviews; and
Public Comments.

By posting publicly on our Site, you agree not to act illegally or violate these terms and conditions.

Accounts

When you create an account on our Site, you agree to the following:

You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account.
All of the personal information you provide to us through your account is up to date, accurate, and truthful.
That you will update your personal information if it changes.

We reserve the right to limit, suspend, or terminate your account if you are using our Site illegally or if you violate these Terms and Conditions.

Sale of Services

These Terms and Conditions govern the sale of services available on our Site and Business.

The following services are available on our Site and Business:

Transportation
Courier Services
Light Roadside Assistant Services

These services will be paid for in full before the time the service is scheduled. No services will be scheduled without payment in full unless otherwise agreed upon.

These terms and conditions apply to all services offered by STAT Ride LLC. All information, descriptions, or images we provide about our Services are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all services we provide. You agree to purchase services from the Company at your own risk.

We reserve the right to modify, reject, or cancel your order whenever it is necessary. If we cancel your order and it has already been paid for and processed, we will issue you a refund equal to the amount you paid. You agree it is your responsibility monitor your payment instrument to vefify receipt of any refund.

Payments

We accept the following payment methods for our Services:

When you provide us with your payment information, you authorize our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorize us to charge the amount due to this payment instrument.

If we feel that your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.

Refunds

We provide refunds for services as follows:

Advanced Bookings

For a full refund for services, we must receive a cancelation through text or email (time dated) at least 14 days before the scheduled service.
For a partial refund for services, we must receive a cancelation through text or email (time dated) at least 7 days before the scheduled service. At that time 75% will be refunded. The standard deposit of 25% to secure the time, date, and driver is forfeited.
For a minimal refund for services receive a cancelation through text or email (time dated) at least 48 hours before the scheduled service. With confirmed cancelation you will receive 25% refund.
All other cancelations less that 48 hours before the scheduled service are not awarded.

Same day bookings

Same day bookings and cancelations are subject to a 30-minute cancelation policy. After booking the ride and paying the fare you can receive a 75% refund as long as it has been no more that 30 minutes since you booked and paid for the services.

Cancelation Rules

All cancelations must be made by email (info@stat-ride.com) or by text (706-431-8877). This method provides a time and date stamp for your protection.
Even if we process the refund immediately, it could take up to 10 days for your bank to process and post the refund.

Consumer Protection Law

Where any Comsumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation, the mandatory provisions of that legislation will apply.

Limitation of Liability

STAT Ride LLC our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities, and expenses including legal fees from your use of this site or services rendered.

Indemnity

Except where prohibited by law, by using this site you indemnify and hold harmless STAT Ride LLC our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities, and expenses including legal fees arising out of your use of our site or services or your violation of these Terms and Conditions.

Applicable Law

These Terms and Conditions are governed by the laws of the State of Georgia.

Dispute Resolution

Subject to any exceptions specified in these Terms and Conditions, if you and STAT Ride LLC are unable to resolve any dispute through informal discussion, then you and STAT Ride LLC agree to submit the issue first before a non-binding mediator and to an arbitrator in the event that mediation fails. The decision of the arbitrator will be final and binding. Any mediator or arbitrator must be a neutral party acceptable to both you and STAT Ride LLC. The cost of mediation or arbitration will be paid by the unsuccessful party.

Notwithstanding any other provisions in these Terms and Conditions, you and STAT RIDE LLC agree that both retain the right to bring an action in small claims court and to bring an action for injunctive relief or intellectual property infringement.

Additional Terms

Fraudulent Reversal of Charges

If you reverse a payment for services after the services have been rendered, STAT Ride LLC will seek out criminal and civil actions to recover the reversed funds. Failure to pay for services rendered is a crime and punishable under the law (Theft of Services and Fraud).

Expulsion of Bodily Fluids

The expulsion of bodily fluids that create a bio-hazard situation in one of our vehicles when services are rendered will result in damage charges on your payment instrument.

Bodily fluids include:

Spit
Urine
Feces
Seamen
Vomit

The charge for these damages is $500.00 due to the nature of the damage and the cost of having the vehicle professionally cleaned.

Vandalism

If you are caught vandalizing the interior or exterior of our vehicles while services are being rendered we will press criminal and civil charges. We will also ask for actual damages, loss of use, loss of income for the company and driver, and punitive damages.

Smoking

If you are caught smoking in one of our vehicles when services are being rendered there will be a $250.00 cleaning fee charged to your payment instrument.

Drug Use

We have zero tolerance for drug use. If you use illegal drugs in our vehicles while services are being rendered, we will report you to the police immediately.

Return of Personal Property

If we find your personal property in our vehicles after your service has ended, we will call, text, and email you. You will have 48 hours to respond. We will not hold your property after 30 days. When you respond if you are within driving distance, we will send the driver back to you with your property. The cost for the return service is $25.00 return fee plus $1.00 per mile. If you are already out of the area, we will mail you the property. The cost for mail return is $25.00 return fee plus postage with tracking and receipt of post fees.

Severability

If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

Changes

These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions.
